1. About these terms

These Terms and Conditions (the “Terms”) govern access to visims.com and the products and services made available through it (together, the “Services”). The Services are operated by NEW INFRASTRUCTURE LIMITED (“Visims”, “we”, “us” or “our”).

By accessing or using the Services, you confirm that you have read and understood these Terms and agree to them. If you do not agree, do not use the Services.

If you accept these Terms for a company or another legal entity, you confirm that you have authority to bind that entity. In that situation, “you” and “your” refer to the entity. These Terms form an electronic contract even though they are not physically signed.

2. Our role in providing eSIM services

Visims resells eSIM services. The eSIM profiles offered through the Services are provisioned and managed through our upstream infrastructure provider, AIRGSM PTE LTD. We facilitate customer access and provide customer support.

3. Eligibility and accounts

You must be at least 18 years old to use the Services.

If you open an account, you must provide accurate contact information, keep the account secure and accept responsibility for activity carried out through it. Tell us immediately at hi@visims.com if you become aware of unauthorised account use or another security breach. We are not responsible for loss caused by your own acts or omissions in relation to account security.

We may review a new account before enabling access, but are not obliged to do so. We may suspend, disable or delete all or part of an account where the account holder breaches these Terms or engages in conduct or content that may damage our reputation or goodwill. False contact information may result in termination. If we delete an account for those reasons, we may prevent re-registration, including by blocking the associated email or IP address.

4. Prices, payment and order controls

You must pay the charges shown and applicable when payment becomes due. Products and prices may change, and we may refuse an order.

If we regard a transaction as high risk, we may ask for a copy of valid government-issued photographic identification and may also ask for a copy of a recent bank statement relating to the card used. We may limit or cancel quantities bought by one person, household or order to address suspected fraud or unauthorised use. We may apply those controls to orders connected by customer account, payment card, billing address or shipping address.

The website may offer credit cards, debit cards or other payment options for VIC purchases. Payment transactions are processed through payment providers.

5. VIC credits

5.1 Nature and value of VIC

VIC are internal, non-fiat virtual credits that can be used on Visims to acquire digital products. They are not money, electronic money, stored value or a payment method outside the platform. VIC have no monetary value away from Visims and cannot be redeemed for cash, withdrawn or transferred to another user or account.

5.2 Packages and conversion rates

VIC are sold in predefined packages beginning at 10 VIC. That minimum concerns the denomination of the digital-credit package; it is not a minimum card-transaction amount.

The base rate is:

  • 1 VIC = EUR 1.00
  • 1 VIC = GBP 0.87 as the reference rate for transactions in British pounds.

For payments in currencies other than euros, the VIC amount ultimately credited may vary slightly with prevailing exchange rates and any fees applied by the payment provider or card-issuing bank.

5.3 Use, refunds and expiry

A VIC balance may be used only for eSIM plans and related services on Visims. VIC purchases are final and non-refundable, except where applicable law requires otherwise. VIC cannot be converted back to cash.

VIC expire after an account has been inactive for 12 consecutive months. Customers should use their balance before that period ends to avoid forfeiture.

6. Electronic delivery

All Visims products, including eSIM profiles and VIC credits, are digital and delivered electronically. Following successful payment, eSIM QR codes or manual activation codes and VIC credits are provided through the email address linked to the account and/or displayed in the account dashboard.

Delivery normally occurs immediately after confirmation of the transaction, but in some cases can take up to 10–15 minutes. You need a stable internet connection and a compatible device to receive and use an eSIM. If the digital product has not arrived within 30 minutes after purchase, email hi@visims.com.

7. eSIM refunds

Refund eligibility depends primarily on whether the eSIM credentials have already been supplied. A request made before delivery may qualify in the circumstances listed in the Refund Policy. Once the QR code or activation information has been sent by email or made available in the Visims dashboard, the purchase is normally final even if the profile remains uninstalled or inactive.

The Refund Policy also describes the limited exception for a technical defect verified as attributable to the supplied eSIM or service, together with any remedy required by applicable law. Customer-side setup problems, incompatible devices and local network conditions are not treated as product defects.

Send a request to hi@visims.com within 7 days of purchase. Our target is to assess it within 3 business days. The Refund Policy contains the evidence requirements and complete eligibility rules.

8. Product and website information

Descriptions, prices, availability, promotions or offers may occasionally contain errors or omissions. We may correct inaccurate information and may update or cancel affected orders, including after an order has been submitted. We have no general obligation to update or clarify information except where the laws of England and Wales or relevant UK consumer-protection rules require it. A date shown on the Services does not mean that all content was updated on that date.

9. Third-party services

If you choose to access or enable a third-party service, that provider’s own terms and privacy practices govern your dealings with it. We do not control or endorse a third-party service merely because it can be reached through or used with Visims. We are not responsible for its content, data handling, security practices or your interaction with its provider.

You may have to register or sign in with the third party. By enabling that service, you permit us to disclose information to the extent necessary to facilitate your use of it. To the extent permitted by law, you waive claims against NEW INFRASTRUCTURE LIMITED arising from your access to or reliance on third-party services.

10. Backups

We make regular backups of the website and its content and use reasonable efforts to keep those backups complete and accurate. Following hardware failure or data loss, we will seek to restore backups to reduce disruption and downtime.

11. Advertising and external links

Any correspondence, promotion or transaction between you and an advertiser or sponsor appearing through the Services is between you and that third party, including any associated terms, statements or warranties. We do not accept responsibility for those dealings.

The Services may link to websites, applications or other resources operated by third parties. A link does not imply our approval, sponsorship, association or endorsement unless we expressly say otherwise. Some links may be affiliate links, which means we may receive a commission if you follow the link and make a purchase. We do not undertake to examine or evaluate third-party offerings and are not responsible for third-party actions, products, services or content. Review the terms and policies of any external resource before using it.

12. Prohibited conduct

You must not use the Services or their content to:

  • break the law or encourage another person to do so;
  • infringe our intellectual-property rights or anyone else’s rights;
  • harass, abuse, threaten, defame, demean or discriminate against another person on grounds including gender, sexual orientation, religion, ethnicity, race, age, national origin or disability;
  • submit information that is false or misleading;
  • distribute malware, viruses or other harmful code;
  • spam, phish, pharm, pretext, spider, crawl or scrape;
  • pursue an obscene or immoral purpose; or
  • interfere with or bypass security controls applying to the Services, third-party services or the internet.

We may terminate access for a breach of these restrictions.

13. Intellectual property

All copyright, trade marks, designs, patents, inventions, goodwill, passing-off rights and other intellectual-property rights in the Services remain with NEW INFRASTRUCTURE LIMITED or the relevant third-party owner. This includes registered and unregistered rights, applications for those rights and equivalent rights wherever they arise.

These Terms do not transfer ownership of any intellectual property to you. They also do not grant you permission to reproduce or otherwise use our or a third party’s trade marks, service marks, graphics or logos.

14. Service disclaimer

The Services are supplied on an “as is” and “as available” basis. To the fullest extent the law permits, we disclaim express and implied warranties, including warranties of merchantability, fitness for a particular purpose and non-infringement.

We do not promise that the Services will meet every requirement or operate without interruption, delay, security issue or error. We do not warrant that results or information obtained through the Services will always be accurate or reliable or that every defect will be corrected. Material or data obtained through the Services is used at your discretion and risk. Unless expressly stated, advice or information received from us or through the Services does not create an additional warranty.

Nothing in these Terms excludes warranties, rights or remedies that cannot lawfully be excluded.

15. Limitation of liability

To the fullest extent permitted by applicable law, NEW INFRASTRUCTURE LIMITED and its affiliates, directors, officers, employees, agents, suppliers and licensors will not be liable for indirect, incidental, special, punitive or consequential loss. This includes loss of profit, revenue, sales, goodwill, use of content, anticipated savings or business opportunity, and loss arising from business interruption, whether the claim is based on contract, tort, warranty, breach of statutory duty, negligence or another legal theory, even where the possibility of the loss was known or foreseeable.

To the maximum extent the law permits, the combined liability of NEW INFRASTRUCTURE LIMITED and its affiliates, officers, employees, agents, suppliers and licensors arising in connection with the Services will not exceed the greater of one dollar and the amount you actually paid in cash to NEW INFRASTRUCTURE LIMITED during the one-month period before the first event giving rise to the claim. This limit applies even if a remedy does not fully compensate you or fails in its essential purpose.

Nothing in this section limits liability where doing so is prohibited by applicable law.

16. Indemnity

You agree to indemnify NEW INFRASTRUCTURE LIMITED and its affiliates, directors, officers, employees, agents, suppliers and licensors against liabilities, losses, damage and reasonable legal costs arising from a third-party allegation, claim, action, dispute or demand connected with content you submit, your use of the Services or your wilful misconduct.

17. Suspension and termination

In addition to the account measures described above, we may terminate your use of the Services if you engage in prohibited conduct or otherwise breach these Terms. Provisions which by their nature are intended to continue after termination remain effective.

18. Assignment

You may not assign, resell, sublicence, transfer or delegate any right or obligation under these Terms without our prior written consent. An attempted transfer without that consent is void.

We may assign some or all of our rights or obligations to a third party as part of a merger or a sale of all or substantially all of our assets or shares.

19. Severability

Each provision applies only to the extent permitted by law. If a court with authority finds a provision, or part of one, illegal, invalid or unenforceable, that provision will be limited to the minimum extent needed and the rest of these Terms will remain in effect.

20. Governing law and disputes

These Terms, including their formation, interpretation and performance, are governed by the substantive and procedural laws of England and Wales.

We encourage you to email hi@visims.com first so that we can try to resolve a concern about a transaction. This does not restrict your right to start a formal dispute or chargeback with your card issuer or bank. A chargeback or payment dispute will be handled under the relevant payment-network rules and applicable consumer-protection law.

Subject to any rights that cannot lawfully be excluded, proceedings relating to these Terms are subject to the exclusive jurisdiction of the courts located in England, and you submit to those courts’ personal jurisdiction.

21. Changes to these Terms

We may amend these Terms by publishing a revised version through the Services. The revision will take effect when posted, and the “Last updated” date will be changed. If you continue to use the Services after publication, that continued use constitutes acceptance of the revised Terms.
